Update on Quartz Coalition Response to Cambria CVD’s

THE FOLLOWING IS AN EMAIL FROM THE POLICY RESOLUTION GROUP (PRG) REGARDING NEW TRADE PETITIONS FILED BY CAMBRIA, IN ADDITION TO THE ANTI DUMPING COUNTERVAILING DUTIES (CVD) ALREADY IMPOSED ON QUARTZ SURFACES IMPORTED FROM CHINA.

THE EFFECT OF THE CVD’S IS TO PROVIDE CAMBRIA WITH AN EXTREME PRICE ADVANTAGE (MONOPOLY) ON QUARTZ SURFACES, AS THEY HAVE EFFECTIVELY ELIMINATED A LARGE PART OF THEIR COMPETITION WITH THE IMPOSITION OF THESE DUTIES. TO BE CLEAR, THESE CVD’S DO NOT LEVEL THE PLAYING FIELD, THEY DO NOT BRING QUARTZ PRODUCED IN CHINA IN LINE WITH CAMBRIA’S COSTS (AND PRICES). RATHER THEY MAKE THE PRICE OF QUARTZ SURFACES FROM CHINA UNTENABLE FOR MOST EVERYONE.

Coalition Members and friends,

On May 8, Cambria filed new trade petitions against imports of Quartz Surface Products from India and Turkey.  As with the China case, Cambria’s action threatens to lock quartz imports from India and Turkey out of the U.S. market.  We already are fighting Cambria at the U.S. International Trade Commission regarding this new trade case.

As you know, an important issue is whether Cambria has standing to represent the U.S. industry producing quartz surface products.  This is an issue to be decided by the U.S. Department of Commerce within the next week.  Accordingly, we urge all U.S. fabricators to complete the enclosed declaration accurately, truthfully, and completely by no later than Tuesday, May 21 and send to Nicholas Laneville at Hogan Lovells at nicholas.laneville@hoganlovells.com.   Please contact Nicholas at 202 637 5763 if you have questions.

Nicholas will compile the declarations and submit them confidentially to the U.S. Department of Commerce as part of a submission opposing Cambria and its new petitions.
